GENERAL TERMS AND CONDITIONS FOR THE COMPETITION “#SAGIONARACHALLENGE”
FROM 9th JULY 2021 TO 24th JULY 2021

Participation in the Competition “#SagionaraChallenge” organized through the Cosmos Sport official Instagram page (“Competition”) implies the acceptance by the participant of these General Terms and Conditions, which are accessible through the Cosmos Sport official Instagram page https://www.instagram.com/cosmossport/ and the Cosmos Sport official website https://www.cosmossport.gr/(the “Cosmos Page”).
Promoter: The Promoter of the Competition is Alpargatas Europe S.L.U., with corporate address at Avenida del Arroyo del Santo, 4 bis, 28042, Madrid (Spain) and with tax number B-85358596 (the “Promoter”), in partnership with Cosmos Sport S.A., with registered office at 62 Martiron Avenue 148, 71303, Iraklio (Greece).

Duration and participation: The duration of the Competition will be from 9th July 2021 at 00:00 to 24th July 2021 at 23:59h -Central European Time- (“Competition Period”). Participations made beyond the Competition Period will not be considered. Participation is open to physical persons, over 18 years old and resident in Greece. Each participant must ensure that his/her participation in the Competition is lawful and in accordance with the laws of Greece. Employees of the Promoter (and their direct relatives) and any company affiliated to the Promoter shall be excluded from the Competition.

Description of the Competition: During the Competition Period, the Promoter will post a publication on the Cosmos Page inviting users to participate in the Competition.

Any contestant wishing to participate shall
1.Use the CosmosSports x Havaianas filter (that the contestants will be able to find on the IG account of @ CosmosSport)
2. Share a content of how they spend their summer though the filter and adding the tags @ CosmosSport & @HavaianasEurope
3.Comment on the post of the influencer as they deem

The Prize and the winners: Upon expiration of the Competition Period (i.e. on July 21st 2021), five (5) winners will be randomly selected out of all the participants in the Competition according to present General Terms and Conditions. Each winner will have the faculty to bring one (1) friend to enjoy the Prize together.
The winners will win a day on the beach with a special guest and many other Havaianas gifts & surprises (the "Prize"). The winners will not be allowed to choose the articles constituting the Prize.
All winners of the Competition will be immediately contacted by the Promoter and requested to provide their full name and (shoe) size. The Promoter undertakes to use this data only to contact the winners for the purposes of the management and processing of this Competition.
The Prize is non-transferable, non-refundable and, in any case, will not be substituted by a different item nor by its value in cash, except as provided in Clause 6(iii) below.
The effective granting of the Prize is subject to the full compliance by the winners with the present General Terms and Conditions and to the trueness of the data provided to the Promoter. The Promoter reserves the right, at its reasonable discretion, to automatically disqualify without previous notice any participant whose conduct is contrary to the General Terms and Conditions of participation to the present Competition or who is performing an undue or abusive use of the Competition.
Data Protection: Pursuant to the current legislation on data protection, the Promoter informs the participants that the participants’ data will be processed by Alpargatas Europe S.L.U. with corporate address at Avenida del Arroyo del Santo, 4 bis, 28042, Madrid (Spain), as the data controller, with the sole purpose of managing their participation in the Competition.
The personal data will be stored for the period necessary for the fulfilment of the purposes described above, and, where appropriate, for the fulfilment of contractual obligations and the relevant legal responsibilities.
The data may be disclosed to companies of the Alpargatas Group, which may be located within the European Economic Area.
In this regard, Alpargatas hereby informs that it has adopted all the necessary legal measures in order to ensure that the transfer of data to such countries is secure and in accordance with the provisions of the applicable legislation.
Participants may file a complaint with a control authority and exercise their rights of access, rectification, deletion, opposition, limitation of processing and portability by contacting [email protected] or in writing to Alpargatas Europe, S.L.U., located in Avda. Arroyo del Santo 4Bis, 28042 Madrid (Spain).

Disclaimers: The Promoter reserves the right, at its sole discretion:
Disqualify a participant or replace a winner with another winner if there are reasonable grounds to believe that such participant has violated these Terms and Conditions and/or has benefited directly or indirectly from any act that contravenes the Terms and Conditions of the Competition.
In this regard, the Promoter declares that it has mechanisms in place to detect any possible fraudulent, abnormal or intentional action aimed at altering the normal participation in this Competition.
To cancel the Competition, in the event that the Competition cannot be carried out, due to malicious acts, technical errors or any other reason beyond the Promoter's control and which affects the normal running of the Competition.
To provide an alternative Prize of equal value or amend the Terms and Conditions at any time, in the event of reasonably unforeseen circumstances. In such circumstances, the Promoter will use all reasonable endeavours to notify participants of any such change.

Limitation of liability: The Promoter will not liable for damages resulting from errors, technical malfunctions, delays or interruptions in the transmission of data or for the use of the application and participation in the Competition, including any injury or damage produced to any computer or propriety of any participant or other person related with or derived from playing or downloading any kind of material of the Competition, unless that damage is provoked intentionally by Alpargatas Europe S.L.U. or its directors, employees or subcontractors, or caused by gross negligence or violation of general obligations.

Applicable law and jurisdiction: This Competition is subject to Spanish Law. If any clause or part of these General Terms and Conditions is held invalid or unenforceable, that clause or part thereof shall be deemed excluded and the rest of the rules will remain applicable. Any dispute or interpretation regarding these General Terms and Conditions shall be settled by the competent courts of the city of Madrid, Spain.
